1. Acceptance of Terms
By accessing or using the website located at culturetravelhistory.com (the "Site"), requesting information, creating an account, or purchasing or reserving travel services from Culture Travel History Journeys LLC ("Culture Travel History," "we," "us," or "our"), you agree to be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms in full, you must not use the Site or our services.
These Terms constitute a legally binding agreement between you and Culture Travel History Journeys LLC, a limited liability company organized under the laws of the State of New York, with its principal business address at 99 Wall Street, Suite 5868, New York, NY 10005, USA, within New York County. Your use of the Site after any update to these Terms constitutes your acceptance of the revised Terms to the extent permitted by applicable law.
Where you enter into a separate written contract for a specific journey, group departure, or custom itinerary, the provisions of that contract will control for the subjects it expressly covers, and these Terms will apply as supplemental terms for all other matters including website use, intellectual property, liability limitations, and dispute resolution, except where the written contract explicitly states otherwise in clear language.
You represent that you have read these Terms carefully, that you understand them, and that you have had the opportunity to seek independent legal advice if you wish before accepting them. We may refuse service, cancel reservations, or suspend access to the Site for any user who we reasonably believe has violated these Terms or applicable law.
2. Description of Services
Culture Travel History arranges and sells curated cultural travel experiences and related planning services. Our offerings include, without limitation: multi-day heritage tours that emphasize historical sites, monuments, and interpretive programming; short-format museum weekends focused on collections, exhibitions, and curator-led or scholar-led commentary; scholar-led packages in which academic experts or credentialed guides lead structured learning itineraries; private guide services for individuals or small groups seeking customized pacing and thematic depth; and airfare bundles that combine negotiated or retail air transportation with land arrangements where expressly described in your booking documents.
Unless your confirmation states otherwise, services are provided by Culture Travel History as an organizer and coordinator. Third parties such as airlines, hotels, motorcoach operators, local guides, museums, site managers, and government authorities may impose their own rules, hours, fees, and safety requirements. We describe itineraries in good faith based on information available at the time of publication, but schedules, access, and included elements may change due to weather, closures, security conditions, labor actions, public health measures, or other factors outside our reasonable control.
Nothing on the Site constitutes a guarantee that any particular departure date, guide, or site visit will occur exactly as illustrated. We will use commercially reasonable efforts to provide suitable substitutes of comparable quality when substitutions are necessary, subject to the cancellation and refund provisions in Section 6.
3. Eligibility
You must be at least eighteen (18) years of age to use the Site, create an account, or enter into a booking agreement with Culture Travel History. By using the Site or submitting a reservation request, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into binding contracts under the laws applicable to you.
If you are booking on behalf of a minor or another adult, you represent that you are legally authorized to do so and that you accept financial responsibility for all travelers named in the booking. You agree to provide accurate traveler names, dates of birth, passport details, and emergency contact information as we request for operational and regulatory compliance.
Certain itineraries may impose additional fitness, mobility, or health requirements because of walking distances, stairs, uneven terrain, altitude, or long travel days. You are responsible for assessing whether a trip is appropriate for your physical condition and for consulting qualified medical professionals as needed before departure.
4. User Accounts and Registration
Where we offer account registration on the Site or through our consultants, you agree to provide truthful, current, and complete information and to update that information promptly when it changes. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You must notify us immediately at [email protected] if you suspect unauthorized access or any security breach related to your account. We may suspend or terminate accounts that appear to be compromised, that violate these Terms, or that remain inactive for extended periods, subject to any records retention obligations we may have.
We may send transactional messages related to your inquiries, bookings, payments, and itinerary changes to the email address associated with your account. You agree that such notices satisfy any requirement for written notice when electronic notice is permitted by law and when you have provided a valid email address.
5. Booking and Reservation Terms
A reservation request does not create a confirmed booking until we issue written confirmation and receive any required deposit. Unless your written quote or invoice specifies a different amount, a non-refundable deposit of five hundred United States dollars ($500.00) per traveler is due at the time of booking to secure space on group departures and packaged itineraries, subject to availability and vendor confirmation.
Remaining balances are due according to the payment schedule stated on your invoice or confirmation. Typical schedules require final payment no later than a specified number of days before departure (often sixty to ninety days, depending on the product), but the dates on your confirmation control. Failure to pay on time may result in cancellation of your reservation and forfeiture of deposits in accordance with Section 6.
Published and quoted prices for land arrangements are ordinarily based on double occupancy, meaning two travelers sharing one room with one bed or two beds as described in the itinerary. Single travelers who request a private room may be subject to a single supplement fee as disclosed at booking. Triple or quad occupancy may be available on limited departures and will be priced separately when offered.
Airfare bundles, when offered, are priced as combined products or as separate air and land components as clearly stated in your documents. Airline tickets are subject to carrier rules, fare rules, change fees, and baggage policies. Name corrections, date changes, and cancellations on air may incur additional charges payable to the carrier or our air ticketing partner.
All amounts are stated in United States dollars unless another currency is expressly agreed in writing. You are responsible for any bank fees, wire charges, or foreign exchange differences associated with your method of payment.
6. Cancellation and Refund Policy
If you cancel your confirmed reservation, refunds of amounts paid toward the land portion of your trip, if any, will be determined based on the date we receive your written cancellation notice at [email protected] or through a cancellation method we authorize in writing. The following schedule applies unless a separate written agreement for your group or charter states different terms:
- Sixty (60) or more days before the scheduled departure date: You will receive a refund of all amounts paid toward the eligible land package, minus a two hundred fifty United States dollar ($250.00) per booking administrative fee to cover planning, vendor communication, and processing costs.
- Thirty (30) to fifty-nine (59) days before the scheduled departure date: You will receive a refund equal to fifty percent (50%) of amounts paid toward the eligible land package, not including amounts already allocated to non-refundable vendor deposits beyond our control, which we will identify when practicable.
- Fewer than thirty (30) days before the scheduled departure date: All amounts paid are non-refundable, and no credit will be issued except where we are able to resell your space to another traveler at our sole discretion and elect to offer a partial credit or refund as a courtesy, which is never guaranteed.
Airfare, insurance premiums, visa fees, optional excursions purchased through third parties, and certain non-refundable supplier deposits may not be recoverable regardless of cancellation timing. If Culture Travel History cancels a departure for low enrollment or operational reasons before departure, we will offer you a comparable substitute itinerary where possible or a refund of amounts paid toward the cancelled land services, excluding any third-party costs we are unable to recover.
If a force majeure event described in industry practice, such as war, terrorism, natural disaster, epidemic disease controls, or government prohibition on travel, makes performance illegal or practically impossible, refunds and credits will be handled according to supplier terms, applicable travel regulations, and any specific provisions in your confirmation. Nothing in this Section limits our right to offset amounts you owe us against any refund otherwise due.
7. Travel Insurance Recommendation
We strongly recommend that you purchase comprehensive travel insurance from a licensed insurer that covers trip cancellation, interruption, emergency medical treatment and evacuation, baggage loss or delay, and supplier default, with limits appropriate to the total cost of your trip and your personal circumstances. Travel insurance is not included in our standard package price unless your written confirmation explicitly states that a policy is bundled and identifies the insurer and coverage summary.
You acknowledge that unexpected events can cause financial loss even when you cancel for covered reasons, and that our cancellation policy in Section 6 may leave you responsible for non-refundable payments. You agree to review policy terms, exclusions, and pre-existing condition rules directly with your insurer or broker before purchase.
If you decline insurance, you assume the risk of uninsured losses. We do not warrant the solvency of any insurer or the payment of any claim. Our staff may answer general questions about timing of insurance purchase relative to final payment, but we do not provide insurance advice or tax advice.
8. Intellectual Property
All content on the Site and in our brochures, itineraries, emails, photographs, videos, logos, trademarks, trade dress, written narratives, maps, and educational materials (collectively, the "Content") is owned by Culture Travel History Journeys LLC or used under valid license. The Culture Travel History name, branding, and curated descriptions are protected by copyright, trademark, and other intellectual property laws of the United States and other jurisdictions.
You receive a limited, non-exclusive, non-transferable license to access and print portions of the Site for personal, non-commercial use in connection with evaluating or participating in our services. You may not copy, scrape, frame, mirror, distribute, publicly display, perform, modify, create derivative works from, or exploit the Content for commercial purposes without our prior written consent.
You may not remove copyright notices, proprietary legends, or digital rights management information from materials we provide. Unauthorized use may result in civil and criminal penalties. If you believe material on the Site infringes your intellectual property rights, contact us at [email protected] with sufficient detail for us to evaluate your notice under applicable law.
9. User Conduct
You agree to use the Site and our services only for lawful purposes and in a manner that respects the rights of other travelers, staff, guides, and local communities. Without limiting the generality of the foregoing, you must not:
- Violate any applicable local, state, national, or international law or regulation, including export control and sanctions laws.
- Harass, threaten, defame, discriminate against, or endanger any person, or engage in conduct that could create a hostile environment on a group tour.
- Transmit malware, attempt unauthorized access to our systems, interfere with security features, or conduct denial-of-service attacks.
- Use automated scripts, bots, or scrapers to collect data from the Site without permission, except public search engines may index pages as generally permitted by robots standards we post.
- Impersonate Culture Travel History, our employees, or another traveler, or misrepresent your affiliation with any person or entity.
- Use the Site to transmit unsolicited commercial messages or spam to us or to third parties whose contact data you obtained through our services.
- Remove, damage, or deface cultural property, museum exhibits, or natural features at destinations, or disobey reasonable instructions from guides or site staff related to safety and preservation.
We may remove you from a trip without refund if your behavior endangers health or safety, seriously disrupts the experience of others, or violates these rules, consistent with applicable consumer protection law.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Culture Travel History Journeys LLC and its officers, members, managers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost goodwill, or loss of data, arising out of or related to your use of the Site or participation in our services, even if we have been advised of the possibility of such damages.
Our aggregate liability for any claim arising out of or related to these Terms or your travel arrangements, whether in contract, tort, or otherwise, shall not exceed the total amount you paid to Culture Travel History for the specific booking giving rise to the claim during the twelve (12) months preceding the event alleged to cause the loss, except where applicable law in the State of New York prohibits such a cap for certain categories of claims, in which case our liability shall be limited to the minimum extent permitted by that law.
We act as an intermediary for many third-party services and do not own or operate airlines, hotels, or all ground providers. To the extent permitted by law, we are not responsible for acts or omissions of independent suppliers, government authorities, or other travelers. Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum extent permitted in your jurisdiction.
11. Disclaimer of Warranties
THE SITE AND ALL CONTENT, ITINERARIES, DESCRIPTIONS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT SUCH DISCLAIMERS ARE PROHIBITED BY LAW IN THE STATE OF NEW YORK OR YOUR PLACE OF RESIDENCE.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected promptly. Descriptions of destinations reflect general knowledge and may not capture every risk or regulatory change. You assume responsibility for verifying entry requirements, health advisories, and travel documents before departure.
No oral or written information obtained from Culture Travel History creates any warranty not expressly stated in these Terms or in a signed written agreement for your specific trip.
12. Indemnification
You agree to defend, indemnify, and hold harmless Culture Travel History Journeys LLC and its officers, members, managers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; (c) your conduct during travel; or (d) your negligence or willful misconduct.
We will provide you notice of any claim subject to indemnification when we are not legally prohibited from doing so. You may not settle any claim that imposes an obligation on us or admits fault on our behalf without our prior written consent. We reserve the right to assume exclusive defense of any matter subject to indemnification at our expense, in which case you agree to cooperate reasonably with our counsel.
13. Governing Law and Venue
These Terms and any dispute arising out of or relating to the Site or services provided by Culture Travel History shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles that would require application of another jurisdiction's laws.
You agree that the state and federal courts located in New York County, State of New York, shall have exclusive jurisdiction over any action or proceeding arising out of or relating to these Terms or your relationship with Culture Travel History, except that we may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.
You consent to personal jurisdiction in New York County, State of New York, and waive any objection based on inconvenient forum, to the extent such waiver is enforceable. If you access the Site from outside the United States, you are responsible for compliance with local laws where you reside.
14. Severability
If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction in the State of New York, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving the original intent as closely as possible.
Failure by Culture Travel History to enforce any right or provision shall not constitute a waiver of that right or provision unless acknowledged in writing by an authorized representative.
15. Changes to Terms
We may revise these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will post the updated Terms on this page and update the "Last updated" date above. Material changes may also be communicated by email to the address associated with an active booking or account where appropriate.
Your continued use of the Site after the effective date of revised Terms constitutes your acceptance of those changes for future use. If you do not agree, you must stop using the Site. Bookings confirmed before a change will generally be governed by the Terms in effect at confirmation, except where law requires application of updated provisions (for example, certain dispute resolution or privacy requirements).
